Terms and Conditions
1 – Membership
By submitting any form on our website or giving out information to any of our representatives either during the photo session or vi Customer Care Center, you agree to accept the Terms and Conditions of our Service(s).
2 – Ordering Photo Prints
2.1 Online or Customer Care Center: PhotoUncle offers ordering via Online mechanism and Customer Care Center, for detailed information regarding ordering of photo prints, please visit our Ordering FAQ’s page.
2.2 Quality of Photo Prints: PhotoUncle agrees to provide the best quality prints as per industry standards. You agree that the quality of the print(s) may vary in case the digital files are uploaded by you. Therefore, it is likely that for certain prints, the quality of the print(s) may not be satisfactory for which PhotoUncle shall not be responsible.
2.3 Pricing of Photo Prints: All the prices stated on our website are in USD. Taxes, shipping and packaging charges as applicable will be added.
2.4 Restricted reuse of service: You hereby acknowledge that you will not try to reproduce, sell or resell, duplicate, and copy any part of the print(s) for any commercial purpose(s) without the express prior written consent of PhotoUncle.
2.5 Cancellation of Order: Your satisfaction is important to us. We do understand there could be some circumstances wherein you might want to cancel your order. In case you placed your order online, you need to call our Customer Care Center within 24 hours of placing such order, in case you placed an order on Saturday or a day before public holiday, please call back on the next working day to proceed the cancellation. In case you opt for cancellation, 25% fee will be charged in case the order has not been dispatched for delivery, and in case the order has already been dispatched for delivery, cancellation will not be possible.
2.6 Delivery of Order: PhotoUncle is committed to deliver your order within the specified time period which is generally between 3 – 4 weeks from the date when you select the pictures for editing. In case of delays in delivery due to unforeseeable and unavoidable reasons, PhotoUncle shall not be held responsible. PhotoUncle assumes that the address provided by you is correct and either courier company or PhotoUncle shall not be held responsible for delivery at incorrect address if the address specified at the time of ordering is incorrect.
2.7 Credit card payment: PhotoUncle agrees that it does not store any credit card information in database. At the time of payment while placing an order, user could be redirected to the third-party website where user is required to provide the credit card details. PhotoUncle would not have any control of the information on the third-party website and would not take any responsibility for the misuse of the credit card information provided by the user to the third party.
2.8 Share with family and friends: You can now announce your new arrival to family and friends by forwarding them a share email which is sent separately along with your welcome email. The share email will contain a link to your private portrait page. You will also have the ability to email invites or post your favorite photo on your Facebook wall via your online baby portrait page.
2.9 Removal of data: PhotoUncle is responsible for taking care of your data in terms of pictures not yet delivered as committed, however it’s due responsibility of client as well to understand that client is equally responsible to respond back for picture selection once he/she has been given a link to select images for editing purposes. In case the client has not initiated the selection process or did not submit enough information as a part of selection process up to 6 months, PhotoUncle will remove the data in order to maintain the level of data storage. In case the client has any genuine reason for us to maintain the data for some time, the client needs to initiate the request ahead of time within 6 months of photo shoot or else PhotoUncle shall not be held responsible for any removal of data older than 6 months.
2.10 Editing: PhotoUncle is responsible for taking care of your request to retouch or edit the images of your choice, however the process works with your (client) cooperation and availability. Basic retouching is available free of cost (that includes color correction, light correction & basic skin retouching), however if client is not satisfied, he/she has all the rights to request for re-editing work, up to two times. Creative editing is available on demand only and will be charged on hourly basis and client needs to discuss the same during picture selection or at the time of booking the photo shoot(s).
3 – Governing Law
This Agreement will be governed by and construed in accordance with the judiciary laws of California without giving effect to any principles or conflicts of law to different states in US. PhotoUncle may modify, move, change, suspend or end any part or all of the service(s) provided by PhotoUncle if asked by law.
PhotoUncle may disclose Personal Information that it collects if, in its opinion, such disclosure is required to comply with legal process or procedure, for example, search warrant or other governmental inquiry or order. It may also disclose such information in response to a law enforcement agency’s request or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by law. We may also disclose Personal Information to assist us in collecting a debt owed by you in case the payment processing has some issues or if the payments are done in installments.
4 – Security
In case you got the access to your account provided by us, you may protect online access to your Account with a password you select. You alone are responsible for any and all activity that occurs on our Sites under such password. Any security code or password used for using services provided by PhotoUncle are for your personal use and you are requested not to share the security code or password with anybody. You agree that it is your responsibility to keep the security code or password confidential and you will be responsible for any consequences originated from the misuse of such code or password. You agree to immediately notify PhotoUncle of any unauthorized use of your password or user name or any other breach of security. You agree to provide true, current, complete and accurate information as requested on any form to which our Sites may direct you.
5 – Disclaimer of Warranty
THE SERVICES, SOFTWARE, CONTENT AND/OR MATERIALS AVAILABLE THROUGH THE SITES ARE PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT OR ANY WARRANTY ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. IN PARTICULAR, NEITHER PhotoUncle NOR our agents, directors, officers, shareholders, employees and subcontractors MAKES ANY WARRANTY THAT THE SITE, INCLUDING THE SERVICES, WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, THAT THE SITES OR ANY SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, THAT THE SITE, INCLUDING THE SERVICE(S) WILL BE AVAILABLE, OR THAT DATA OR IMAGES ENTERED ARE SECURE FROM UNAUTHORIZED ACCESS. NEITHER PhotoUncle NOR our agents, directors, officers, shareholders, employees and subcontractor MAKES ANY WARRANTY REGARDING ANY SOFTWARE, GOODS, SERVICES, PROMOTIONS, OR THE DELIVERY OF ANY SOFTWARE, GOODS OR SERVICES, PURCHASED, ACCESSED OR OBTAINED THROUGH THE SITE OR ADVERTISED THROUGH THE SITE(S). NO ADVICE OR INFORMATION GIVEN BY PhotoUncle NOR our agents, directors, officers, shareholders, employees and subcontractor OR AFFILIATES SHALL CREATE A WARRANTY.
6 – Indemnity
You agree to indemnify PhotoUncle, its agents, directors, officers, shareholders, employees and subcontractors against all liabilities, claims and expenses that may arise out of or in connection with any: breach of these Terms by you or through your Account; or User Content associated with you or your Account.
7 – No Call No Show
You agree and understand if you no call no show as per your scheduled appointment or want to cancel your appointment on the day of shoot itself, you are basically forfeiting your session and we may not be able to schedule any further session with you again. Please be mindful that when we block off a time spot for you, we are holding that spot for only you. Therefore, we are not able to schedule someone else. No call no show clients is deemed business loss and no booking amount whatsoever paid in advance (non-refundable in nature) can be adjusted anywhere.
8 – Entire Agreement
These Terms are intended to contain your entire agreement with us relating to your use of and access to PhotoUncle; we believe them to be fair and reasonable. They replace all earlier agreements and understandings with you relating to PhotoUncle. Besides this you can go through our Privacy Policy as well for further information.
